Regulation 11(3) is ultra vires the Housing Development (Control and Licensing) Act 1966 because section 24 does not authorize the Minister to delegate the power to waive or modify the statutory Schedule H contract to the Controller; therefore the Controller had no power to waive or modify Schedule H or to deny purchasers' liquidated damages rights, and the purported extension in the letter dated 17.11.2015 was not a valid Ministerial decision and is of no effect.
