The Court of Appeal held the Attorney-General acted lawfully and reasonably in granting consent under s.9 GPA to Nai and Ho to pursue OS 1128 to allow the courts to determine whether the 1845 public charitable trust had been impermissibly converted; the High Court erred in quashing that consent by judicial review and its order was set aside.

The Court of Appeal held the AG acted lawfully and reasonably in granting consent dated 31.5.2016 under s.9 GPA to allow Nai and Ho to pursue OS 1128; the High Court erred in quashing that consent by JR because the AG considered relevant matters, did not act in bad faith, and his consent was a legitimate means to enable the court to examine whether a historic public charitable trust had been impermissibly converted; therefore the HC order quashing the AG's consent was set aside and the appeals allowed.

The Court of Appeal held the Attorney General acted within lawful discretion and reasonably in granting consent under s.9 GPA to Nai and Ho to pursue OS 1128; the High Court erred in quashing that consent because material issues as to whether the 1845 public charitable trust had been validly converted into a private trust required judicial determination and the AG did not act mala fide or irrationally.
