The Court applied Ang Ming Lee to hold that Regulation 11(3) is ultra vires and any extension granted under it and any contractual amendment predicated on it (Clauses 25 and 27 to 54 months) are void; estoppel cannot validate a void statutory modification; the appellant's LAD claim accrued on delivery of vacant possession and was within the limitation period; the writ action was the correct mode as the extension is void ab initio; accordingly the High Court's refusal of summary judgment and striking out were set aside and summary judgment was ordered for the appellant.
