The Tribunal lawfully applied s35(1) to exclude 167 days and recalculated the date for vacant possession; the RM50,000 payments and Settlement Letter did not constitute a clear, certain settlement of LAD because the letter did not refer to LAD and payments predated crystallisation of LAD; therefore the Tribunal's award of RM45,115.61 for LAD was lawful and not amenable to judicial review, so the applications are dismissed.
