The court held that on the facts the stakeholder-held booking sum did not effect contract formation until the stakeholder paid out the funds to the developer on 29.7.2015; Supreme Court and Court of Appeal authority requiring protection of purchasers is binding where facts are comparable; therefore time for calculating liquidated damages runs from 29.7.2015 and not 15.12.2015 or 1.6.2015.
