The court held that failure to serve the s.43 notice rendered the High Court land reference order null and void; section 56 LAA does not validate non-service and is inapplicable; section 68 LAA does not bar a suit to set aside an impugned High Court order in a land reference when that order is a nullity; delay by the plaintiff did not preclude relief because a nullity can be attacked at any time. Consequently the application to set aside the order was allowed and costs were awarded.
