On the balance of probabilities the 2nd Tenancy Agreement was entered into because Plaintiff's representative misrepresented authority of prior tenant; lodging a police report, not served and not followed by action, did not effect termination; Plaintiff voluntarily vacated and also breached the tenancy by using the land for office and living quarters contrary to Clause 3.06; Plaintiff failed to prove special damages with factual evidence; accordingly Plaintiff's claim dismissed and Defendants' counterclaim for removal allowed.
