Given the executor's death, the absence of an appointed administrator, the urgency caused by the estate asset being on the market, and the consent of the only other interested party, it was in the interests of justice to grant leave, remove the named executor and appoint the applicant as executor; the application is therefore granted and costs may be paid from the estate.
