Costs awarded to the second respondent because r 14.2(a) requires costs to follow the event and the applicant's personal circumstances did not provide a legally sufficient basis under r 14.7(g) to refuse or reduce costs; accordingly the applicant must pay $8,655 plus $200 disbursements.

Costs awarded to respondent on a category 2B basis but capped at respondent's actual incurred costs of $22,250 because appellant unnecessarily prolonged proceedings, much of the further evidence was manifestly unsatisfactory, there was no satisfactory evidence that an award would be contrary to the child's welfare, and the High Court Rules and Care of Children Act permit such an award.

A liquidator's notice issued under s292 (as pleaded) must, when addressed to a natural person, be served in accordance with s391 of the Companies Act 1993 (i.e. as if serving a creditor or shareholder) because the High Court Rules do not prescribe methods of service for such notices which are not 'proceedings' under the Rules; accordingly paragraph 38 of the statement of claim is not vulnerable to strike out on that basis.
