The Statement of Claim was struck out because the plaintiff lacked standing to bring the asserted causes of action against this defendant and the pleading had incurable deficiencies; the first cause under s131 could not be maintained without HBPHL and Mr Austin as parties and could not be remedied on the present pleading, and the second cause under s164 failed because the plaintiff was not a company director, shareholder or otherwise an entitled person and s164 relief is prospective only.
