Because Mr Holland was legally aided and no exceptional circumstances were shown, the Court could not order costs against him. The Court certified what would have been awarded but for legal aid: conventional travel and accommodation disbursements of NZD 568.91 (AUD 550 converted at judgment date). Australian legal fees must be sought in the Australian proceedings and interest on borrowed funds to pay legal fees is not a proper disbursement recoverable in this proceeding.
