The High Court dismissed the s 299 appeals and held that, apart from one immaterial reference to belated enforcement action, the Environment Court's factual findings and exercise of discretion were open on the evidence and lawful; the Environment Court did not err in principle in awarding 60% of the s 274 parties' claimed costs and in apportioning responsibility between Cable Bay and Auckland Council, so the costs award stands.
