The Environment Court was entitled to award costs given it found St Heliers advanced unsubstantial and unmeritorious arguments (Bielby factors); however the judge made a material arithmetic error inconsistent with his clear intention to award approximately 50% of the costs claimed, so the High Court allowed the appeal in part and substituted corrected costs awards of $96,000 to each respondent (total $192,000).
