Refusal to accept the Calderbank settlement did not, judged at the time it was made, justify increased costs under r14.6(3) and the defendant was entitled to defend so indemnity costs under r14.6(4)(a) are not appropriate; costs after 27 June 2014 are awarded on a 2B scale with allowance of $796 for item 10 and $1,741.25 for item 35, yielding plaintiff costs of $30,397.25 after deduction of $4,676.50, plus disbursements of $14,602.72.
