Because NZ Water Purifier Ltd was a party to ongoing legal proceedings when it was removed from the Register and s329 authorises restoration in those circumstances, the Court ordered restoration; the procedural objections and claimed diplomatic immunity did not negate the statutory basis for restoration.

Because the defendant was successful, the plaintiffs raised no tenable grounds to depart from the ordinary rule that costs follow the event, and their procedural complaints were irrelevant to the costs question, the Court awarded the defendant category 2B costs of $11,343.00 plus disbursements of $564.20, total $11,907.20.

On the medical evidence before the Corporation and the Review Officer there was no admissible proof that any mental injury was the outcome of the 1991 physical injury; the physical injury had resolved and specialists attributed ongoing symptoms to pre-existing psychological/behavioural conditions, therefore the Corporation correctly concluded there was no causal link and lawfully ceased cover.
