Judge found offending to be of moderate gravity but that the real and appreciable risk of deportation and consequent forced separation from the defendant's four-year-old New Zealand citizen son were out of all proportion to the gravity of the offence; satisfied s107 and exercised discretion to discharge without conviction under s106 Sentencing Act 2002.
