The RSB lawfully declined to give the blanket, pre-emptive confidentiality undertakings sought; s151 is permissive and allows disclosure for statutory purposes subject to safety considerations, the RSB's interpretation that it was obliged to disclose in all circumstances was an error of law but not one warranting setting aside the decision because the ultimate refusal was lawful, not unreasonable, did not breach natural justice or NZBORA, and relief was denied; stay for delay was premature.
