Although plaintiffs succeeded on the preliminary valuation questions, awarding costs at this interim stage would be premature because liability remains undecided and the preliminary determination is provisional as to liability; accordingly costs are reserved pending determination of the substantive proceedings and the decision in Cousins was distinguishable.
