Although PWI Limited succeeded only on some grounds, the overall result favoured PWI and the most significant issues were resolved for the respondent; 2B categorisation was appropriate; taking account of partial success the court awarded reduced costs of $5,000 plus disbursements of $110 and $50 (total $5,160) to PWI Limited against the applicants jointly and severally.

The Court held that the Registrar-General had substantiated the grounds for refusal under s217 and was correct to refuse to issue the certificates of title; consequently costs follow the event and are awarded to the Registrar-General in the 2B category in the sum specified.

Mr B failed to comply with a direction to file company accounts and did not explain the omission, causing unnecessary preparation by Mrs B's counsel; that conduct justified a 10% increase on the 2B costs scale. However, Mr B's reliance on authority and his response to the Calderbank offer did not by themselves justify increased costs. A deduction was warranted for the first case management conference appearance; remaining calculation of costs is to be carried out by counsel or submitted by memorandum.
