The judge preferred the earlier orthopaedic opinions and the occupational physician's review that the appellant's current incapacity is substantially caused by pre-existing degenerative spondyloarthropathy rather than the discrete 1996 lifting incident; the appellant failed to prove on the balance of probabilities that the 1996 accident is the substantial cause of his present symptoms, therefore the suspension of weekly compensation from 14 October 1998 was correctly maintained and the appeal is dismissed.
