Leave to appeal was refused because s 14 of the Supreme Court Act 2003 permits direct appeals only in exceptional circumstances, none were shown, and this Court had previously indicated the Court of Appeal's view would be useful on the identical issue; accordingly Collins J's striking out of the judicial review as disclosing no reasonably arguable cause of action is not a matter for direct appeal to this Court.
