The application for leave to bring a second appeal is declined because the material did not raise an issue of general or public importance nor demonstrate a miscarriage of justice; the High Court properly considered a disclosed expert report and correctly concluded Dr Drummond's evidence was not fresh nor sufficiently cogent to admit in the interests of justice.

Application to disqualify Chapman Tripp dismissed: plaintiffs failed to establish a realistic or more-than-negligible risk the firm would be required to defend its own prior legal advice in the substantive proceedings and the asserted divergence of interests between the Body Corporate and committee members was speculative and reliant on an unpleaded basis (Unit Titles Regulations argument raised late); the application was premature and the Body Corporate had independent opinion and a members' vote to retain Chapman Tripp.
