NGUYEN v NEW ZEALAND POLICE [2023] NZHC 1045

High Court found the District Court Judge erred by excluding home detention based on a deterrence rationale targeted at a community and without proper comparison to sentences for offenders of similar culpability; recalculated discounts (25% guilty plea, 10% personal mitigation) and credit for EM bail yielded an 18 month custodial equivalent, which the Court commuted to nine months' home detention to give effect to s7 and s8 and the requirement to impose the least restrictive appropriate sentence.

The appeal was allowed in part: the Court found the global starting point adopted by the sentencing Judge exceeded the appropriate range for the overall gravity of the offending; recalculation produced a lawful starting point of 6 years 3 months before mitigation, the Judge's 30% total mitigation discount was upheld, and to give practical effect the sentence on one cannabis supply charge (Charge 25) was reduced from two years to six months while all other sentences remain intact.

M v NEW ZEALAND POLICE [2022] NZHC 796

The uplift of eight months for driving while disqualified was a material error because it exceeded the statutory maximum for that offence; correcting the uplift to one month reduced the end sentence to five months' imprisonment, and taking into account the appellant's time under restrictive bail conditions justified conversion to three months' community detention and 15 months' intensive supervision, therefore the appeal is allowed and the sentence substituted accordingly.

The High Court held the District Court's starting point and totality assessment were within range, the psychological report showed contributory but not causative mental health factors, a modest increase in discount to 15% for background/mental health (from 10%) was warranted but overall discounting produced a 45% reduction which did not render the sentence manifestly excessive, and therefore the appeal was dismissed.
