The Court found that, on the balance of probabilities, the claimant failed to prove the back injury occurred in the course of employment because of lack of contemporaneous complaint, absence of observed posture/gait abnormalities, unresolved motive to avoid working notice, and thus the Review Officer's acceptance of the claim could not stand.
