The defendants were entitled to limited particular discovery: RBL must disclose documents in its control recording or explaining the calculation of the components of the Crown compensation payment because the defendants pleaded that full compensation would render clause 3(f) of the Side Letter inapplicable, making the calculation materially relevant; broader discovery of all negotiations was refused as not proportionate or necessary.

Westpac breached its mandate by unjustifiably refusing to disburse funds; on the facts Westpac should have acted when it received the 29 February 2008 letter (received 2 March 2008) and therefore interest under the Judicature Act is payable from 2 March 2008; the High Court's indemnity costs order was not justified and is quashed.
