SCOTT v WILLIAMS [2018] NZSC 37
- Citation
- [2018] 1 NZLR 633
- Court
- Supreme Court
The Court held that the appellant's claim for interest on the s15 award from the date of separation was dismissed because such an adjustment would amount to increasing a finally determined s15 award and, if relevant, should have been reflected in the s15 calculation (not by post-judgment interest) and required expert evidence which was not appropriate at this stage. The respondent was entitled to interest at five per cent per annum under the Judicature Act on $290,751.34 from 20 February 2014 and on $51,591.13 from 6 June 2014 to the date of payment. No costs were awarded for the application.
