The Court declined to alter its prior decision to not make a conventional costs award against the defendant but exercised its discretion to direct that reasonable legal costs be met from the estate: defendant's costs of $13,922.50 were directed to be paid from the estate and plaintiffs' costs of $21,944.56 were also directed to be paid from the estate given the successful application, subject to the estate not being required to pay amounts it has already paid.
