On the evidence, including medical opinion demonstrating the defendant's impaired capacity and given the consent of Public Trust and the defendant's counsel, the defendant's interests were not compromised and a vesting order under s 52(2) Trustee Act 1956 was necessary and appropriate to allow the District Land Registrar to transfer title to the plaintiff and his wife as executors so the property may be sold.
