An inspection order under r 9.34 was granted because inspection was necessary to enable the plaintiff to determine and quantify alternative remedies (specific performance or damages) and to calculate quantum of damages; the order was not unduly intrusive and it is desirable to determine all issues at one hearing where possible.

Because the plaintiff had advanced funds for construction and holds contractual/title interests while the vessel and materials remain partly completed and at risk, the court granted interim preservative orders (restraining removal/appropriation, payment of unexpended funds into solicitor's trust account, and inspection rights) to protect the plaintiff's and other parties' interests, with costs reserved.
