Because Police and Crown disclosure obligations were comprehensively and belatedly breached producing substantial late disclosure (including material capable of affecting key evidence), the court found a reasonable apprehension of miscarriage of justice and that it was highly expedient for the ends of justice to discharge the jury under s22(3)(a) of the Juries Act 1981; the trial was aborted and will be rescheduled.
