Leave to appeal dismissed because s22 of the Juries Act manifests legislative acceptance that a fair trial can proceed with fewer than 12 jurors, no arguable Bill of Rights breach or risk of miscarriage of justice was shown, the trial judge properly applied the emergency/casualty test and sentencing fell within an appropriate range.
