The appellant agreed at the 25 October 2006 case conference to waive the 'set by' date to obtain further medical evidence and thus contributed to the delay under s.146(1)(b), so no deemed review decision arose; additionally the District Court lacked jurisdiction to consider the Code complaint in absence of a primary decision and due to s.149(3).
