The review decision of 23 November 2007 (regarding the respondent's 31 August 2007 decision) was correct because the 31 August decision granted taxi transport entitlement; the Court has no jurisdiction in this appeal to decide on subsequent non‑payment of 17 September 2007; the appeal was therefore dismissed as without merit.

Appellant failed to establish, on the balance of probabilities, a causal link between the 1982 covered injury and his current condition; independent specialist evidence concluded symptoms attributable to degenerative change or pre-existing condition and, in any event, any symptomatology from the 1982 accident would likely have resolved within two years, therefore no statutory entitlement to weekly compensation arises and the appeal is dismissed; additionally the Court lacks jurisdiction to award damages or the non-statutory relief sought.

Rule 709(4) should be applied flexibly to serve the interests of justice; the Court will permit amendments that are relevant and necessary to resolve genuine errors in the impugned decisions and decline irrelevant or non‑justiciable additions or those properly pursued in another forum. Applying that test the Court granted leave in part (permitting specified amendments dealing with delay and the reasonableness of costs) and struck out unrelated supplementary purported appeals to the High Court concerning annual practising certificates which are appealable only to the District Court.
