The plaintiffs and Council proved liability and quantum by affidavit and documentary evidence and the second and third defendants failed to comply with timetabling orders and did not file evidence; accordingly the court properly entered judgment against those defendants for the proven sums with Judicature Act interest.

The Supreme Court granted leave and framed the appeal to determine whether Premium's failure to disclose constituted a breach of fiduciary duty or the Fair Trading Act 1986, whether disgorgement of the Trust's profits is payable to the Stevens, and whether the Court of Appeal correctly assessed and quantified damages.

The court held that Mr Halford, having acquired his unit before the manifestation of damage, was entitled to a judgment on liability against the developers (Mr and Mrs Barton); however, to avoid prejudicing other parties and to address outstanding issues of standing, duty and quantum, judgment on liability for the remaining plaintiffs was reserved and a further quantum hearing was ordered.
