A temporary speed limit validly set in accordance with the Rule remains in force from installation of the sign until the authorised person removes the sign or 12 months elapse; failure by contractors to remove the sign when a site is unattended does not 'unset' a valid temporary speed limit, therefore the appellant exceeded the posted 50 km/h limit and the conviction stands.

Applications for third‑party disclosure were dismissed because the applicant failed to establish a realistic evidentiary foundation that the requested medical records and coronial materials were necessary for determination of his proposed appeal; the materials were not fresh, could have been produced at trial, the applicant provided no particularised grounds of appeal or explanation for delay, and disclosure was not necessary or expedient in the interests of justice.

Qualified privilege in defamation does not operate as a defence to breach of a protection order; the correct enquiry is whether the appellant had a 'reasonable excuse', and on the facts (egregious content, messages foreseeably forwarded to the protected person, burden on appellant to prove excuse) no reasonable excuse existed, therefore the conviction is upheld.

The Court of Appeal held Chief Judge Colgan did not err in ordering a rehearing; the Employment Court's power to rehear is broad, the standard for rehearing encompasses a substantial possibility or real risk of miscarriage of justice, the Nurses Organisation's s179 challenge raised a distinct and broadly significant question which Judge Ford failed to decide, and the Employment Court also has a power of recall in appropriate cases.
