Given the quantity, persistence, diversity of offers and number of potential purchasers the High Court inferred the appellant could make good on offers; Zhang band 2 was applicable and a four-year starting point was within range; uplifts totalling six months for offending while subject to intensive supervision and for breaches were available; generous discounts (50% overall) produced a 27-month sentence which was not manifestly excessive; appeal dismissed.

The High Court found the District Court erred by imposing an excessive starting point for the offering to supply charges, failing to discount for proven addiction and s 27 personal factors, and failing to apply the totality principle; the appropriate adjusted sentences were substituted resulting in an aggregate term of 16 months' imprisonment and the appeal was allowed in part.

Defendant's manufacture and distribution of very large quantities of high‑purity methamphetamine placed his offending in Fatu band 4; taking into account his lesser role relative to the principal cook but acknowledging significant involvement, the appropriate starting point was 20 years, reduced by 5% for personal mitigation and 20% for the guilty plea to an effective term of 15 years, with concurrent sentences on related counts and a 50% minimum period of imprisonment ordered.
