The Court preferred the treating surgeon's opinion (Krause) because he had direct clinical examination and contemporaneous history indicating an acute, significant tear caused by the fall; imaging interpretations indicating chronicity and 35mm retraction were contested and insufficient to conclude the tear was caused wholly or substantially by a gradual degenerative process under s26; therefore ACC is liable to fund the repair surgery and the review decision declining funding is quashed.
