O'Neill v Accident Compensation Corporation

- District Court
On the balance of probabilities the medical evidence (weighted to the opinions of Dr Hartshorn, Mr Welsh and Mr Denholm) establishes that any SLAP lesion was not caused by the 5 August 2007 lifting incident nor by a work-related gradual process; the correct compensable condition is a work-related rotator cuff/impingement syndrome and allied disorders, therefore the respondent's decision declining cover for the SLAP lesion is upheld and the appeal is dismissed.
