The judge accepted Professor Burry's diagnosis that protracted keyboarding and the workstation/postural demands caused soft tissue/postural muscle injury (trapezius myalgia/fibromyalgia); that finding was not negated by other reports and satisfied the requirement that the employment had the relevant property or characteristic under s7(1)(a); the judge also found s7(1)(c) satisfied because prolonged keyboard work places clerical workers at significantly greater risk. Accordingly the Review Officer's decision was revoked and the appeal allowed.
