JM v Accident Compensation Corporation
- Citation
- [2014] NZACC 329
- Court
- District Court
The court held Dr Henderson's assessments were not demonstrably flawed: her WPI findings and apportionments were within acceptable clinical judgement, complied with AMA Guides and the ACC User Handbook, the procedural challenge to reassessment failed because the applications justified combined assessment, and there was no evidence that ACC influence or double counting produced error; accordingly the appeal was dismissed.
