The overall custodial sentence of two years' imprisonment was within the available range and not manifestly excessive; home detention was inappropriate given the offending and purposes of sentencing, but specified rehabilitative release conditions were imposed.

The High Court held the sentencing starting point and discounts were within range and not manifestly excessive but allowed the appeal in part because the District Court made a reparation order without adequate inquiry into the offender's means; the matter is remitted to the District Court under s 251(2)(c) Criminal Procedure Act 2011 to obtain a s 33 reparation report and to reconsider whether to impose reparation, its amount and any effect on sentence.

The Judge did not err: the psychiatric report established a drug-induced psychosis which is excluded from mitigating consideration under s 9(3) of the Sentencing Act, the offences involved multiple victims, force and threats making them relatively serious, and the appellant failed to provide sufficient evidence of adverse consequences of conviction; accordingly the refusal to discharge without conviction and the 10 week sentence were upheld.
