The offending was a push causing the victim to strike his head and die; this is materially less culpable than a forceful punch so a 3 year starting point was appropriate. That starting point was adjusted upward for prior offending and leaving the victim unattended and attempting to deflect responsibility, and reduced for substantial personal and cultural mitigation (approximately 20%), guilty plea credit (approx. 15%), and one month credit for electronically monitored bail, resulting in an effective sentence of two years and one month imprisonment.
