The High Court held there was no reviewable error in the District Court judge's decision: the Police's brief representation that the charge would be withdrawn and the subsequent two-day reassessment reversing that decision did not amount to an abuse of process; the Solicitor-General's Guidelines do not by themselves create a legal bar to reopening prosecutions and do not alter the established authorities that a prosecutorial change of position will not automatically warrant dismissal; judicial review of s147 decisions is narrowly confined and intervention was not imperative.
