The decision to offer no evidence was unlawful because it gave effect to an arrangement under which the prosecution would not be continued on condition that a $3.41 million payment be made; that conditional arrangement constituted a bargain to stifle prosecution contrary to public policy and the prosecutorial framework set out in the Solicitor-General's Prosecution Guidelines and statutory enforcement purposes, and therefore the decision was quashable and a declaration was warranted.
