The landlord may recover solicitor-client costs only for those costs that are of and incidental to enforcement of the landlord's rights and remedies asserted in the extant proceeding; costs arising from separate steps or separate proceedings are not recoverable as part of the court's costs order and must be claimed and established by separate contractual cause of action if sought.

Because the contract contained an unambiguous solicitor-client costs clause, the respondent provided invoices and time records showing costs properly incurred, and the applicant did not oppose the costs claim, the court ordered that the applicant pay the respondent the full solicitor-client costs claimed plus disbursements totalling $36,771.13; GST was not payable as the respondent is a foreign company.

Despite Taste of Asia's success on the merits, its deliberate and serious concealment of an unauthorised sublease justified a costs award to Hillcrest; indemnity costs under the lease clause were declined but Hillcrest was awarded costs on a Category 2B basis plus disbursements as fixed by the Registrar, with only a single award where overlapping steps were taken.

Leave to appeal was dismissed because the dispute is a private contractual interpretation of an unusually worded repainting clause, the financial stakes (roughly $9,000 additional repainting costs) are modest compared with the litigation costs already incurred (nearly $17,000) and the issue lacks sufficient public importance to justify the cost and delay of a further appeal under the s 67 test.
