On proper construction of s 73(1) of the Broadcasting Act 1989 the Electoral Commission is required to allocate to each qualifying political party time for an opening address and time for a closing address; the Commission erred by excluding non‑parliamentary parties from closing addresses. The allocation of $10,000 to non‑parliamentary parties based on a basic radio campaign was potentially flawed but no formal declaration was made on that point due to mootness; appeal allowed and declaration made on the s 73(1) issue.
