The Racing Board acted unlawfully by promoting an agreement that purported to delegate to itself the power to (a) unilaterally extend the life of an allocation methodology beyond the year without fresh code agreement and (b) reduce distributions by reference to the Board's own unstated criteria; multi-year allocation methodologies themselves can be lawful but the codes may not delegate to the Board the authority to decide extensions or reductions under s 16(3).
