The Court exercised its discretion to award costs to the applicant because the respondent's extensive and unnecessary opposition generated substantial additional work and expense; however, because the application had to be filed as an originating application the filing fees and initial filing/supporting affidavit costs were disallowed and a general one-quarter reduction was applied to many claimed items, resulting in a net award reflecting those adjustments.
