Judge Turner correctly found the prosecution had a strong circumstantial case identifying the appellant as the driver, defence counsel's advice was reasonable and not materially deficient, the arrest/detention did not render the evidential breath test inadmissible, and therefore refusal to allow withdrawal of guilty pleas did not create a miscarriage of justice; appeal dismissed and convictions upheld.

The review is dismissed: the judge upheld the Associate Judge's discretionary refusal to order security for costs for the plaintiff's remaining claims after balancing the plaintiff's right of access to the courts in the NZBORA context, the arguable/some-merit nature of the claims (notably the detention claim against ADHB), and the defendants' interests; ordering security sufficient to prevent the claim would not be just in all the circumstances.
