On the balance of probabilities the medical evidence does not establish a causal nexus between the 1997 back strain and the appellant's 2006 incapacity; imaging and specialist opinion show degenerative and osteoarthritic spinal disease as the operative cause, therefore the appellant is not entitled to weekly compensation.

Medical evidence established that no continuing physical injury from the 1986 accident remained and the appellant's current incapacity was caused by the ongoing effects of pre-existing cervical spondylosis (aggravated but not currently sustained by the 1986 accident); therefore entitlements under the Act could be lawfully suspended and the appeal dismissed.

On the balance of probabilities the Court accepted the treating surgeon's opinion that the appellant continues to suffer incapacitating effects of an L5/S1 disc protrusion attributable to the 1987 accident, so the respondent's decision to suspend entitlements was wrong and must be revoked.
